Aktionsbündnis hat einen Brief an das für das GBS Settlement zuständige New Yorker Gericht geschickt

Das Aktionsbündnis „Urheberrecht für Bildung und Wissenschaft“ hat sich bezüglich der geplanten Einigung der Authors Guild und der Association of American Publishers mit Google Inc. im Rahmen des Google Book Settlements mit einem Brief an das zuständige New Yorker Gericht gewandt. In seinem Schreiben betont das Aktionsbündnis sein generelles Einverständnis mit der Digitalisierung durch Google, formuliert allerdings einige zentrale Einwände bezüglich eines drohenden Quasi-Monopols Googles an digitalisierten vergriffenen und verwaisten Werken sowie der einseitig ausgerichteten Organisation des Book Rights Registry und kritisiert nicht zuletzt die mit dem Settlement gegebene starke USA-Kontrolle über die zunehmend globalen (kommerziellen, aber auch über die freien) Informationsmärkte.

Similar to many other science and library organizations, the CCES is not opposed to approval of the Settlement in general. The Settlement has the potential to provide public access in a new electronic form, not only to books which are no longer copyright-protected but also to books which are no longer available on the market or to so-called orphan works.

Aber:

the CCES continues to worry about whether the Settlement will sufficiently take into account the major concern of an increasing number of scholars and educators, namely to have free access to digitized works and to use them under the open access paradigm. Deshalb:

Scientific works should be excluded from exclusive commercial services such as pay-per-view by default, in particular when these works had been publicly funded.  

CCES cannot accept the Settlement providing Google with a quasi monopoly over the usage of out-of-print and orphan works.

The Settlement should demand that Google and any other future licensees guarantee the long-term preservation of the digitized material.

the Settlement should take into account the global dimension and consequences of the Settlement.

it is unfitting for the Association of American Publishers and  the Authors Guild to be given the exclusive mandate

There should be public control over the contracts for library packages       mentioned above, in particular in order to monitor price policies.

the CCES proposes that the Book Rights Registry be monitored by a neutral international organization, for instance by UNESCO.
